Terms of Service & Community Standards

These Terms of Service and Community Standards (“Terms”) are a binding agreement between you and 3RD Rock Grid, LLC (“we”, “us”) covering your use of the 3RD Rock Grid virtual world, this website, and all related services. By creating an account or accessing the grid you accept these Terms and our Privacy Policy. If you do not accept them, you may not use our services. We may update these Terms from time to time; continued use of the grid after an update constitutes acceptance of the revised Terms.

1. Eligibility — 18 and Over Only

All users must be at least 18 years of age. By registering you affirm that you are 18 or older. Accounts found to belong to minors will be terminated immediately, and encouraging a minor to join the grid is itself grounds for termination.

2. Your Account

  • You must provide accurate registration information and keep it current.
  • You are responsible for safeguarding your password and for all activity on your account. Notify us immediately of any unauthorized use.
  • Your account is personal to you and may not be sold, traded, or transferred to another person. Alternate accounts are permitted, but an alternate account used to evade a ban or suspension will itself be terminated.
  • You permit our staff to access your account or avatar where reasonably necessary to troubleshoot technical problems or investigate violations of these Terms.
  • You should have no expectation of privacy in public in-world chat. Grid services necessarily log activity (including chat, IM, and transaction records), and our staff may review those logs when investigating abuse reports, technical problems, or violations of these Terms. Our handling of this data is described in the Privacy Policy.
  • Accounts with no login for 24 consecutive months may be closed and their assets, including in-world currency balances, forfeited.

3. Your Content

We do not claim ownership of any content you create or upload. Your builds, textures, scripts, animations, and other creations remain yours.

So that we can actually operate the grid, you grant us a non-exclusive, royalty-free, worldwide license to host, store, copy (including backups), display, and transmit your content as needed to provide our services.

You additionally grant us the right to capture and use images and video of your content — including your avatar — in-world, on our website, and in articles, advertising, and promotional material for the grid.

  • Upload only content you own or have the legal right to use. You are solely responsible for the content you upload.
  • You are solely responsible for securing any music or media streaming licenses for streams you run on your regions; we hold no such licenses on your behalf.
  • We may remove any content we deem unacceptable, at our sole discretion, for any reason or no reason at all.
  • Copyright complaints are handled under our DMCA Takedown Policy. Repeat infringers will have their accounts terminated.

4. Community Standards

The following conduct is prohibited anywhere on 3RD Rock Grid:

  • Racism, hate speech, harassment, or bullying of any user, in any form — including chat, IM, profiles, object names, and notecards;
  • Griefing — intentionally disrupting other users’ enjoyment of the grid, including object spam, weapon abuse outside designated combat areas, blocking access, or crashing regions;
  • Gambling and skill games are not permitted. This includes any game of chance or skill played for in-world currency, real money, or anything of value;
  • Disclosing another user’s real-life information (“doxxing”) — including their real name, location, contact details, or images — without their consent;
  • Threats of real-world violence or encouraging self-harm, which may also be reported to authorities;
  • Undeclared bots and traffic gaming — automated avatars must be registered as such with us, and artificially inflating region traffic or visitor counts is prohibited, as is any use of grid resources for purposes unrelated to the virtual world;
  • Illegal activity of any kind, including distributing illegal content;
  • Impersonating our staff or other users;
  • Data harvesting, spamming, or commercial solicitation of users without their consent;
  • Attempting to exploit, reverse-engineer, or interfere with grid infrastructure or other users’ accounts.

5. Content Ratings and Child Avatars

Regions on 3RD Rock Grid carry maturity ratings (General, Moderate, Adult), and you must respect them: adult content and activity belong only in Adult-rated areas.

A “child avatar” is any avatar that presents as, or could reasonably be perceived as, a minor. The following rules are absolute and are enforced without exception:

  • Child avatars are not permitted in Adult-rated areas of the grid.
  • Child avatars may never engage in flirting, sexual talk, sexual role play, or any sexualized behavior, anywhere on the grid, under any circumstances. This applies regardless of the ages of the people behind the avatars.
  • Depictions of sexual ageplay or the sexualization of minors result in immediate, permanent termination of every account involved, and where the law requires or permits, will be reported to the appropriate authorities.

6. Payments, Land, and Currency

  • Fees for regions and other services are due on your billing date. Except as provided by our 30-day money-back guarantee on new region purchases, all payments are non-refundable once made. Prices may change with 30 days’ notice.
  • If your region or land payments fall past due, we may take your region offline and, after a reasonable period, delete its content. A reactivation fee may apply to restore cancelled regions.
  • If your account is past due, you agree that we may confiscate any in-world currency balance held on your account and apply its value, as we determine it, toward your past-due obligations. Confiscated balances are forfeited and will not be restored, even if the account is later brought current.
  • In-world currency on 3RD Rock Grid is provided and operated by independent third-party currency providers, not by us. L$ currency is operated by PODEX, and G$ currency is operated by Gloebit. Your purchase, holding, exchange, and redemption of in-world currency are governed by the terms of the applicable provider, and by transacting in either currency you agree to that provider’s terms. We are not a party to your relationship with these providers and accept no responsibility or liability for currency transactions, balances, exchange rates, redemptions, or losses.
  • Where a currency provider offers redemption (“cash out”) of in-world currency for real-world value, that exchange takes place solely between you and the provider, under the provider’s own terms, rates, fees, and processing schedules. We do not process cash-outs, do not guarantee any particular redemption value or timeframe, and are not liable if a provider limits, delays, or discontinues redemption. You are solely responsible for any taxes arising from your currency transactions or cash-outs. Any balance held on your account is forfeited when your account is terminated for violating these Terms or is abandoned.
  • Each region on the grid uses one currency system — either PODEX or Gloebit — never both at once. Different regions may use different systems, and a balance in one system cannot be spent in a region using the other. It is your responsibility to check which currency a region uses before transacting there, and you agree that we are not liable for purchases attempted with the wrong currency.
  • Initiating a payment chargeback while services have been delivered may result in immediate suspension of your account pending resolution.
  • Region owners in good standing may request an OAR backup of their region; we do not guarantee the completeness or usability of backup files. An OAR backup contains all content present on the region, including content created by others. It is your responsibility to know and understand the licenses attached to all content in the backup, and to ensure that any use you make of it — including restoring it to another region or grid — complies with those licenses and with the creators’ rights. We accept no liability for your use of backed-up content.

7. Enforcement

We reserve the right to suspend, delete, or ban any user, at any time, at our sole discretion, with or without warning, for any reason or for no reason at all. We likewise reserve the right to restrict access to any part of the grid or its services. Banned users may not return under alternate accounts. Upon termination, any remaining in-world currency, content, and land holdings may be forfeited except where we choose, at our discretion, to allow their recovery.

8. Hypergrid

3RD Rock Grid is connected to other virtual worlds via the Hypergrid. When you travel to another grid, or take content there, you do so at your own risk and become subject to that grid’s policies; we have no control over foreign grids and no ability to recover content lost on them. Visitors arriving from other grids are bound by these Terms and Community Standards while on 3RD Rock Grid.

9. Sale or Transfer of the Grid

We may assign or transfer these Terms, and our rights and obligations under them, without your consent, including in connection with a sale, merger, reorganization, or other transfer of 3RD Rock Grid or substantially all of its assets. In that event, your account, your content, and the data associated with them may be transferred to the successor operator, which will be entitled to operate under these Terms until it modifies them. We will make reasonable efforts to notify users of any such transfer. You may not assign your rights under these Terms to anyone else.

10. Changes to the Service

We may add, modify, or discontinue any feature or service at any time. We may also discontinue 3RD Rock Grid entirely; in that event we will make reasonable efforts to give users at least 30 days’ notice so that content backups can be requested and currency balances resolved with the applicable provider. We are not liable for any loss arising from the modification or discontinuation of any service, and no compensation is owed for content, currency, or land holdings upon a shutdown of the grid.

11. Dealings Between Users

Transactions and arrangements between users — including content sales, parcel rentals or subleases, services, and partnerships — are solely between the users involved. We are not a party to them, do not guarantee or enforce them, and are not liable for any loss arising from them. If you rent land or sell services to other users, your customers’ relationship is with you, not with us. We may, at our sole discretion, investigate or intervene in a dispute between users, but we are never obligated to do so.

12. Service Provided “As Is”

3RD Rock Grid is provided for entertainment purposes, “as is” and “as available,” without warranty of any kind. Virtual world software is complex and partly experimental; occasional crashes, rollbacks, downtime, and data loss can and do occur. We do not guarantee uninterrupted service, the preservation of any content or inventory, or any particular commercial outcome from your activities on the grid. You use the service at your own risk.

13. Limitation of Liability and Indemnification

To the maximum extent permitted by law, our total liability to you for any claim arising out of these Terms or your use of the grid is limited to the amount you paid us in the three (3) months preceding the claim, and we are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost data. You agree to indemnify and hold us harmless from claims arising out of your content, your conduct on the grid, or your violation of these Terms or of any third party’s rights.

14. Governing Law and Disputes

3RD Rock Grid is operated from the State of Ohio, USA. These Terms and any dispute arising out of them or your use of the grid are governed by the laws of the State of Ohio, without regard to its conflict-of-law rules. You agree that any legal action arising from these Terms or the services must be brought exclusively in the state or federal courts of Ohio, and you consent to the personal jurisdiction of those courts. The grid is a passive service offered from Ohio, and your use of it does not subject us to jurisdiction elsewhere.

15. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of it. Sections concerning content licenses, forfeiture, disclaimers, limitation of liability, indemnification, and governing law survive termination of your account. We may give you notice by email to your registered address or by posting on this website, and you consent to receiving service-related communications by email. Any suggestions or feedback you send us about the grid may be used by us freely, without obligation or compensation to you. These Terms, together with the Privacy Policy and DMCA Takedown Policy, are the entire agreement between you and us regarding the grid.
